Review the article Insurance Bad Faith and Insurers’ Duty to Communicate with Insureds Regarding Settlement and the U.S.
Supreme Court case State Farm Mutual Automobile Co. v. Campbell. Consider the issue of an insurer’s duty to communicate
with insureds and settle cases when appropriate. As a business owner or manager, how should you go about communicating
with your insurance company and requesting settlement if appropriate? Are there situations in which you might be interested in
settling a matter even if you believe you have a reasonable and probable winning defense? Typically your insurer hires a
lawyer to represent you in the underlying lawsuit. Should you have your own lawyer in relation to encouraging the insurer to
settle if the facts warrant that action? Do you believe the imposition of punitive damages in appropriate in instances of an
insurer’s bad faith refusal to settle? Why or why not? Prepare a paper discussing these issues and expressing your opinions.
In support of your opinions, your paper should address the journal article Insurance Bad Faith and Insurers’ Duty to
Communicate with Insureds Regarding Settlement, the case State Farm Mutual Automobile Co. v. Campbell, and at least one
other peer reviewed journal article. APA formatting should be followed. Note that while in some other weeks you need at least
two other peer reviewed journals, in view of the case law provided, this assignment requires citation of only one other peer
reviewed publication. The substantive portion of the paper not counting, for example, your reference page, should be in the
range of from three to four doublespaced
pages. Representatives of the King library should be available to assist with library
or citation issues. Additionally, a good reference for APA citation is available
