Wesley was lost. He had driven his truck into a street which had now been blocked off for the freeway to go through. He wanted to be on the other side of the freeway. After turning around, with difficulty, he was driving out when Bob, on a motor cycle, cut in front of him. Wesley took evasive action and swerved into a telegraph pole, which fell down crashing into a wharehouse building. This sparked a fire and Wesley’s truck was destroyed. The building was badly affected and was declared a dangerous building which needed to be demolished.
Whilst the wharehouse was being demolished, the street was closed to all access for three weeks and then after that only limited access for pedestrians for a further four weeks. Rita owned a convenience store in that street. She was forced to close for three weeks. Delivery of large and heavy items was stopped for a further four weeks. Rita experienced a significant downturn in profits. She had to lay off Betty, who worked there full-time. Betty could not afford to pay Household Sparkle Ltd who clean her house once a fortnight as she was not receiving any income, so she discontinued this service.
Peta saw the accident and the aftermath of the accident. She did not realise that the driver was fine. She is claiming psychological harm as a result of witnessing this accident.
Wesley’s boss, Conrad, phoned Wesley’s girlfriend, Yvonne, and told her that Wesley had been in a bad accident and the truck was incinerated. Yvonne was so stunned by this that she dropped the phone, so she did not hear Conrad tell her that Wesley only suffered a few bruises. Yvonne is suffering anxiety and is very upset, crying a lot. She seeks help and her doctor diagnosed her as having an anxiety disorder.
Henry, whilst glancing towards the demolition work on the building, rear-ended the car in front. The driver of this car, John, suffered whiplash.
