Hello again class, this week we are evaluating how sentencing guidelines change and how they impact the administration of court operations.  As stated in our previous discussions both federal and state court systems are governed by a set of rules and guidelines.  These rules and guidelines inform others both within the court system and out how the system will operate from day to day, week to week and month to month.  These rules cover everything from how people are searched from entering the court room building to processing guilty individuals out of the court room to Sentencing guidelines.  In January 2005, what is now called a “blockbuster” the United States Supreme court ordered that the U.S. Sentencing Commission had to establish sentencing policies and guidelines (Peck 2011).  These guidelines are to be used to determine how someone should be punished and how much time they should serve based on the crime committed.  This act was to insure that one individual wasn’t punished differently than another.  However in late 2007  the U.S. Supreme Court ruled that the guidelines set in place by the U.S Sentencing Guidelines we just that, guidelines.  They are there to assist the court room, i.e. the Judge or jury on what the system feels someone should serve but they are not limited to that which means they can impose a harsher judgement on someone or a lesser judgement on someone. 

 

Now just like everything else there is a process, and for sentencing guidelines to changer there is a very lengthy process.  To start off the U.S Sentencing Commission will do two things; one is publish a proposed amendment and two is hold a hearing about the sentencing guideline amendment.  This amendment will get sent to Congress who will either accept, hold a hearing, solicit public comments or reject the amendments.  If the amendment is approved the new guideline wont take effect till later in order to give the federal and state court systems time to adjust their proceedings.
