Assignment: Chapter 2
1.    On the morning of trial, the defendant indicates that he has a right to a jury trial, and he wants to exercise that right.  You are the judge and want to make sure you do not overlook anything in the trial.  If you do, the case could be reversed on appeal.  Make a list of the sequence of events in a felony criminal trial, including at what point the defense or prosecution is the participant. Include cross, re-direct and re-cross, and be specific about which side is conducting the examinations, etc.  (10 points)
2.    Susie is a victim of domestic violence.  There are many police reports that are followed, and the police have a long history of abuse documented with photographs.  Susie, however, continuously takes her boyfriend, Bill, back.  He is the father of her 2 year old son, Nick.  One night, Bill gets drunk and very violent.  He is beating Susie.  Then, for the first time ever, he goes after Nick.  Bill said that he was going to kill Nick if she didn’t tell him who she has been running around town with, so as Bill picked up Nick in a violent manner and started shaking Nick, Susie grabbed a gun she had hiding under her mattress and shot Bill.  He died instantly.
a.    If you are the prosecution, describe in detail what kind of people you want on your jury.  Consider gender, age, occupation, religion, marital status, family, etc.  Explain your answer. (3 points)
b.    If you are the defense attorney, describe in detail what kind of people you want on your jury.  Consider gender, age, occupation, religion, marital status, family, etc.  Explain your answer.  (3 points)
c.    A woman on the jury panel indicates that she is a victim of domestic violence and she can’t be fair and impartial.  You are the defense attorney and do not want her on your jury.  What will you do to try to get her removed from the jury? Why? (2 points)
d.    A man on the jury panel indicates he is a domestic violence counselor.  He has been working in another county for many years, and does not work with the attorneys or the police involved in this case.  He does not know any of them, either.  He knows a lot about domestic violence, and has even testified in criminal cases as an expert witness.  He does not know anything about this case other than what he read in the paper, and he indicates that he has not formed an opinion about this case either way.  You are the defense attorney and do not want this man on your jury.   What will you do to try and have him removed from the jury panel? Why? (Even if you think you would not remove him, the question asks you to assume the attorney wants him off, so you need to indicate what you would do to have him removed, legally, and why.  There are many reasons you might not want this person on your jury if you were the defense.  Sometimes the people you think, on paper, will be good are the worst!)  (2 points)
